Gamertag / Xbox Live Ban Question

I've tried searching for this answer, but haven't found it.

If my modded 360 gets banned, does my gamertag account with the 12 month of live subscription get banned as well?  I was thinking if it gets banned, I could buy another 360 and recover my gamertag on that one.  Is this possible?
