Xbox 360 Mods And Using Xbox Live Safe In Some Cases?

I've been poking around the forum.. I seem to see this go in either direction.

I'm wondering if there are any mods/hacks/firmware fixes (DVD) that allow the backup copy of a game to played on xbox live without banning (or so far no banning?)...

A friend said he knows of someone who did a DVD firmware fix (where he connects the drive to the pc to copy) and he hasn't been banned (not sure which one).. Or if there are others that are considered safe to this point..
