Can A Silver Member Be Banned.

MS has not banned anyone yet.  Anyone who tells you anything about what "might" happen, is just speculating.  Just realize there is a chance you could get banned, and adjust your actions accordingly.

Ok, but is it possible to be banned when you are not connected to xbox live, or will we have to wait and see.

Once again we have no idea.  It could be a detection by the dash, which sees you playing offline, and remembers that the next time you connect to live.  We will just have to wait and see, but more than likely it will come with one of the big dash updates.

MS has not banned anyone yet. If MS decides to ban users for modified firmware in the future, the ban should be on the machine,  not on specific live accounts. i.e. when it's time to ban, it doesn't matter whether you are a silver member or gold member, it's your machine's unique id that matters.

We have no idea how MS will be checking, but the latest firmware mods are using more stealth features to "hide" the fact that it is booting backups.

Not technical.
This is yet another speculation post. They seem to be creeping back in.
