M$ did this with the XBOX1 with the HDD marriage code, so the precedent is set.  I'm not sure that anyone can know conclusively until any possible future action happens.

Um, MS has no authority to brick your system, no matter what illegal things you might be doing with it. You purchased the machine, its now yours to do whatever you please with. The only thing that could happen is:

'A') They can refuse to fix it for free once you open it and therefore break the warranty sticker.

'B') Eventually they can probably overwrite your 'hacked' firmware with a legit one if you try to access xbox live, essentially undoing your 'hack' for you, as they did with the original xbox.

'C') They could also legally prevent you from using their xbox live service altogether, the same way you can't access live now unless you have the latest dashboard updates.

My guess is they can only resort to A for now, but they'll eventually do all 3 things like they did with xbox 1. If you want to keep using 'backups', your right as the consumer would be to simply refuse dashboard updates, and therefore forfeit the ability to use xbox live.

People really need to understand their legal rights before running scared with talk of 'bricked' machines. M$ intentially ruining $400 systems that they don't own is not only very illegal but would also generate way too much bad press.
