Does M$ Log Personal Information When Banned

alright so here's my setup
xbox v1.6,xenium spice, 80 gb hdd, everythings on the f part

I created my original xbox live gamertag with the stock drive, no modchip, obviously everything was good to go...decided to mod my box with the 80 gb hdd and didn't know about marriage theory before then, and was of course banned...now this was back in may of 2005

so now I decide I want to get back on live...get a new hdd, new eeprom from zodiiak, dig up some 2 month trials(wow I had five of them, thanks blockbuster)

I get a slayers 2.6 disc and have it rebuild my c part(on the new drive) to the latest ms dashboard.  I then use the xenium hdd wizard and only copy the f part of the old drive to the new, so that I would not have anything on the c, or e partition of the new drive

put the old hdd in, boot evox, load configmagic final, backup everything, load new eeprom and then exit...final step, put the new hdd in and use configmagic to lock the drive.

reboot into the retail kernel, grab the live code and put it in, everythings cool, i'm able to connect with a new gt

play halo 2 for that night(2 nights ago), and some of yesterday with no problems...I don't cheat at all, and I don't even use a headset, so unless some jackass just left negative feedback (which I know happens) theirs no way that M$ would just flag me...UNLESS

does anyone know if M$ flags your credit card, and/or personal information when you get banned?  Because either someone did indeed leave negative feedback on me, and they checked my hdd...or they saw that my new gt's information matched my banned gt's information and they automagically scanned my hdd, and whammo..banned

I haven't booted into anything but the retail kernel for the past two days, so I know that I didn't accidentally access any live tabs on backup games

any thoughts?
