I ask because I modded a friends xbox after it had been on live so I wanted to give him my eeprom. I just want to make sure it hasn't been recorded by MS before I do so.
You would only want to give your friend your EEPROM if he has...
A: Has a banned EEPROM or...
B: Upgraded his HD If hes not banned, and hes not upgrading, then its just wasting a EEPROM. Just because you modded his box After hes been on live, doesnt mean he needs a new EEPROM. It just means he must make sure that he doesnt go on live with the mod on.

Is there any way to know if my xbox has ever been on live? I bought a used xbox and do not know if the previous owner ever used xbox live. When I turned it on the first time it had the "Xbox Live" tab in the MS dash but, can't a live enabled game (Halo 2) install that automatically?
As far as I know, theres no way to tell. The Xbox live tab doesnt mean anything. Dash 4920 includes the Xbox live tab and they started shipping with new Xbox's years ago. So you could buy a new Xbox with the Xbox live Tab (I did) And yes, Halo 2 would install that automatically cause it will update your dashboard.
