no you cant use that eeprom its from a 1.0 youll need a 1.6 eeprom for your box, you then put your hdd on and just to be safe you might want to try a new gamertag.

ok I got a 1.6 eeprom for 10 bucks off ebay.  I have no way of knowing if it's legit is there?  Can anyone answer my other questions?  I would really like to check this eeprom before uploading it because it can ruin the box.

well I was able to open the bin sent to me with eepmod but it does say if it's 1.6 or not.  Can I tell from the serial number in the eeprom?

Get it from Zodiiak at the Buy & Sell forum. He's a very respectable seller.

Hey..

I tried using x3 config live to change my eeprom before changing my hard drive, but for some reason..it didnt change it (flash protection was on, hd was locked, i dunno) and it got me banned... so i wouldnt recommend it. Use ConfigMagic Final and compare eeprom serials before and after update to make sure that you actually changed your eeprom.

Some eeprom sellers, (zodiiak perhaps) finds a friend with xbox who isnt going to be using live, takes his/her unbanned eeprom and flashes it with an old one.

I would suggest doing account recovery to be on the safe side.
