Swapping The Hd For An Idiot

I modded an xbox for a friend and got it working.  He hadn't swapped out his HD yet so he was still using the original Xbox drive.  Like a complete moron he signed up for Live last night and then comes to me today and says he want a new HD.  Assuming the marriage theory is correct is there an way to swap his drive now without getting banned?

I heard there were some cached files somewhere that might help us out but I'm no too sure about that.
