2 Possible Solutions?

I hae 2 questions/ideas that could be a possible solution.

I have a 160GB WD HDD in my xbox. I have some games on it, but I have yet to register for xbl. If I registered using this drive, would I be banned?

Also, say I were to put in the original HDD to play xbox live, and swap back to the 160GB, would that work without me getting banned? Say use the 8gb to use XBL and the 160 just for backups, etc.
