it use to be number 1, but i suspect *oops* has been moved down the list to number 2 of reasons for "modified hardware" bans. look at all these posts from users who genuinely do not know how to operate their chip when playing on xbox live. there is no shortage and some of them post the same questions more than once, even when they get answers - they dont even read their own threads. the reason for this is that they are users and the modded xbox is not a product to be used - it is a product to be exploited, hacked and taken advantage of, but not used.
i admit i had some of my own questions about why all the bans were occurring and will i be banned. so yes, i had doubts that the precautions i knew to take were enough, but i already knew how to use my chip properly and i came here to x-s to read, not to wait for someone to hold my hand.
if you fail to remove the few *xbox live specific* .xbe files that are included in many different games and play those games with the evox bios running on your system, your xbox will attempt to connect to xbl and do a dash update. if you or someone with access to your box attempts to force a connection to xbl with any hacked bios running on your system, your xbox will attempt to connect to xbl and do a dash update. either of these situations which results in a successful connection to xbl, would also get you an immediate ban since you are running a hacked bios.
on to the number 1 reason. several people, including myself, have posted their own testing evidence of the marriage theory - believe it people! i wont link to those threads here because i am not trying to get this pinned or make a tutorial[use the search]. yes, there are other reasons for getting banned and you may even believe that those reasons nullify the marriage theory. if you want to test it, go ahead, but breaking the marriage theory will 100% positively get you banned and it seems to me that this hit has been on top of the *why did i get banned* chart since mid-october.
it appears that m$ waited until they had updated, or maybe sold, enough units with the new live 2.0 so they could sufficiently test their new ban procedures. it worked because the scene got used to the way things had been. however, we see now that m$ has more up its sleeves and they may not stop here.
in any case, i figure i am preaching to the choir because the only people who bother to read are the same people answering the questions.
