I find it a very good experiment to try. I hope to prove that a lot of the confusion that is going on is caused by files being left on the drive that shouldn't be.  This would be some nice evidence.

i think you will NOT GET BANNED ...
why .. bacuse of the stock HDD that ya put back in ..

now this HDD , has it ever been unlock/relocked ??

yes it has been locked and unlocked. It was also completely rebuilt using slayers 2.6.  Still not banned...

as long as you flash the eeprom too before you lock it yes so far so good 30hr and counting..

I was banned a long time ago just after install the modchip because I forgot to remove the autologon feature of xbox live 2.0.
At that time I start read all the newsgroup and after get a new unbanned EPROM from a friend that don't wish to play live I change it and did an account recovery.
Everithing was fine. I had the Stock HD but with many file loaded on E and C. Chip Aladin Advance Plus.
Just some day before HALO 2 whet out I when to modify the xbox of my little sister so I got her eprom to.
Because the friend that gave me the eprom of first place told me that with halo maybe he wish to buy a DSL line a go online I have swap again my EMPROM with the one of may sister. Then after buy Halo 2 I heard a lot of rumor about the ban so before log on I have started to read al this thousen post. A lot of different idea and verry few prove.
I have log on on live with Rainbow six and it ask me to do the update. I did. played for 3 day no ban (file on C and E). that after read a lot of post about scanning HD of GT flagged I have decided to remove everithing not MS on C and E. delete the same from ms dash and go on live with Halo 2.
He ask me again for an update (a bit strange because i already did xbl 3 with rainbow) and that I have played it for 3 day with no ban.
Now the problem is:
Can I put back file on E ? or I will ban?
shell I buy a new big HD and make a swich for change it between original and modded?
Have someone of you guy log on live with flagged GT and stuff on E without get banned?
In all the post I did not saw anybody with alandin chip. Have someone with Aladin chip been ban?

Worked fine with my setup. Been playing Halo 2 since the 12th and no ban.

If you switch the HD after going onto Live you *will* be banned

well prplehz have u read the newest info .. about the 'cookie' on the HDD ?
as in that 80GB hdd was that a XBL virgin... as if not even if ya did format it... then these cookies will still be there !! and thus thats why u got banned ...

this will also explain why putting back you stock HDD (the one that u made your XBL accout on first) works.. as this has the cookie of your 'console' account.

its looking like with that info, and angerwounds info on the HDDkey that there actually flagging (not serial etc)
it seems as thou we got all how bases coverdd and everything explained ..

APART from what else is maybe being scanned on a flagged GT
but even that can be partly/mostly/all summed up by linox 's discoverys
