I have a suspision that once you are banned, M$ writes something or marks your EEPROM or something, and it prevents you from connecting to live (kinda like live preventing mod chips).  The reason I think this is, when you connect to live, it takes a while to send data back and forth, but when you are banned it IMMEDIATELY gives you an error, like its not even trying to connect.

Heres what I would like someone to try, if possible.

1) Take an xbox that is on live and working fine. Doesnt matter if it was banned or not, but preferably one with a stock HD (not sure if this would matter)

2) Obtain a previously banned EEPROM (im sure there are plenty of these hehe)

3) Unlock the hard drive and flash the banned EEPROM onto your xbox

4) Manually change ALL of the values of the banned EEPROM to the values of the working non banned EEPROM
4b) You may want to do an evox backup and compare the eeprom values on ur computer using any eeprom viewing utility (cant remember the name of it)

5) Lock the hard drive and try signing in.

this should NOT violate the old 'marriage theory' because you are using the same EEprom values and the same hard drive, and in theory you should be able to sign in.  If you cannot, it supports my theory of eeprom marking.

as it could VERY easilt be checked !

backup ya eeprom BEFORE going on live etc ..
then get ya self banned
beackup ya eeprom again

and compare the two !

easy ! but its VERY unlikly that its true !
PLUS its still not finding why ya getting banned in the first place.. it will just unban u entill they see why they banned you in the first place !

which is exactly how the new HDD key theory works !

Ok, I've run a file compare tool and the files are DIFFERENT....but LiveInfo shows the SAME details.  Differences at :

C:\XBOX\LiveInfo\test>fc eeprom.bin modeeprom.bin
Comparing files eeprom.bin and MODEEPROM.BIN
00000060: 9E 94
000000B8: 03 0D
000000FC: 00 01

I'm going to try this now.

I highly doubt it will work, if only because someone must have tried this already BUT, like I said, I don't like the way Live instantly rejects you.

now thats interesting !!!!!!!!

ok... why would they of changed ... maybe because of the time/date ?
maybe because of the change in HDD ?

what else could change the eeprom ?

Just tested it now; those differences relate to the hard drive only, because when I flashed the original EEPROM onto my Xbox, it became identical to the banned one.  There is no difference.

thanks for the testing guys! interesting results... but kind of suspected

this doesnt explain why xbox doesnt let you connect so quickly... It may be just my thinking, but I think if we figure out this it may lead to a much better understanding of bannings... If you want you can comment on this or open a new thread, or let it die... i dont care hehe

ill put my thinkin cap back on in the meantime!

Maybe it changes something in the partition table or wherever your xbox live information is stored?
