Hdd Scanning Question

i've read a lot of posts and one of the theories is the hdd scanning theory. due to clashing evidence, i am still unsure about the truth of this theory. so i would like to get information from people that have modchips and unsigned code on the hdd (evox, xbmc, dvd2xbox, etc.) and whether they are unbanned or banned. please make sure that the only variable is the having or unhavingness of unsigned code on the hdd. i would just like to figure out what the majority of people with the same spefications as i experienced.
