Safe To Play Halo2 On Xbox Live If....

Basically I wanted to know if anyone has gotten banned with these circumstances.
I haven't hooked up to XBOX Live after I played my legal copy of Halo2 with the mod chip on and with the DVD in the drive. I have successfully played Halo 2 on Xbox live all week with the mod chip off, I signed on after I modded the HDD.  
Is it safe to play Xbox live after you play Halo2 offline with the modchip turned on?
I heard of a theory of Halo 2 saving info of if Halo2 has been played with the mod chip on before.  Anyone had this happen to them?
