sure enough.  i got mine for 10 bucks.  then again, i traded in my ps2 and a game for it.  good thing.  or i'd be really stuck.  now i got one banned modded box and one virgin box (well, it got to third base, cuz i took out the sammy and dropped in a tommy).  just got lucky i guess.

The way to really hurt M$ is for everyone to buy a second xbox for use on live. MS loses a ton of money on xbox sales. They make all their money on game sales. So if we all buy a second xbox it could really put a dent in them.

I use a Mac, and the ONLY reason I got Xbox was because GCN and PS2 suck and the DC is dead. Xbox is pretty damn good too, I didn't even use Live that much, I buy my damn games and when Halo 2 comes out, the single player sucks and the multiplayer rocks, but I can't play it. I've never liked MS and this reinforces the fact.

I bought my Xbox off ebay for £100 one year ago and now Im banned . I have not even opened it up , so the HDD inside doesn’t look to be the original one.

Now my first worry is how many banned Xboxes will be getting punted on ebay .

Second . I don’t think m$ has any right to scan your hardware without
1 informing the user of this
2 getting the users permission

(If we were to just scan someone’s PC it would be classed ah Hacking)
so what makes this any different ?

Me thinks someone will have to look into the legal side of this ...

I'm fully behind you on this, however, when you sign up for live you pretty much give them the god given right for them to do whatever the hell they want.

You may have heard/seen the Internet Privacy Act of 1995 (431.322.12), signed by bill clinton, fully protecting users/sites from such hacking. Unfortunately this privacy act doesn't exsist and is just hog wash. I do believe such a thing should be introduced as what we do, or in your case haven't done to your xbox is no one's business but yours. I do think MS should be able to do whatever they want to people who peddle pirated games, but having an xbox that has a bigger hd, or a modchip isn't directly damaging MS's wallet.

There is some loop hole though, if you live in spain, where a case was thrown out of court due to some legal loop hole they have in their laws. There my be hope yet.

Read section B doesnt that mean that they can only search files on your hdd related to connecting to live and not dashboard files or hdd size. So they shouldnt be able to do this!!!!! any lawyers out there please contact me at [email protected] i am serious about taking this to their doorsteps!!! they cannot do this!!!!!

I wouldn't go that far, I would say that if they wanted to scan the HDD they could, because in the end it does deal with the xbox live service as if you are going to hack a game, the HDD is pretty much the place to start.  I don't think you found a loophole just yet.

but even if you did modify halo 2 or anything u still gotta boot with chip off and have the cd, which means

1. You paid for the game

2. You paid for the service

3. You paid for the xbox

Shouldnt they just ban people who modify halo and that are reported? i think that would be a little bit more fair.

to me the important part in that section is "to operate and protect the security of the service"

basically, if they see mod-chips as a threat to the security of the service....then that's it...... not really much you can do....if they decide that to log on you need to be modchip free...and can download info that proves this, or doesn't....then that's acceptable

What do you mean reported?  MS has the right to scan the HDD if they wanted to, but I think that right now the HDD serial number and EEPROM marrage is working pretty good for them.  If they were to scan HDD's, I would think that we would notice it because it would take a considerable ammount of time to scan a HDD than just compare two codes (eeprom and serial) .  

M$ just wants to keep XBL fair, so their doing what they can to prevent people with modded games to get on.
