i think swapping your drive is gonna give you a 50/50 chance since you have no clue when the intial scan ran.

a solution you could try, which would also be a test for the rest of us, is to go ahead and change your eeprom BEFORE you are officially banned.  this would tell us if they are matching the serial first, then the hdd.  if they are matching the hdd, then you'll still be banned.  if they arent, you wont.  again, 50/50.  

eitherway, your rolling the dice.

I posted my results in another thread and it answers your question. Its just my opinion, but I think you will be alright. Here is a copy of my post from the other thread. Please let me know if you have any questions I can answer.

OLD POST
I tried something on a hunch and it worked, so I thought I would post it for others to try. Here are the specs of my box:

Xbox v 1.0
120 GB Western Digital Drive
Xecuter 2.3b lite
Never banned

I subscribe to the theory that people who signed up for XBL and played before they modded their box, moded their box with a larger hard drive and then signed into XBL will get banned. I fit into that category.

I signed up for XBL January of 2003.
I played on it until early this year sometime.
I moded my Xbox in August 2004 with the chip and a larger drive.
I did not play on XBL after the box was moded.

Tonight I turned off the mod chip and booted to the MS Dashboard. I went into memory and deleted the things with Xbox icons that I did not recognize. One of them even said undefined. I then went into Xbox Live from the dashboard and my account wasn't there (which is what I expected). I recovered my account and logged into XBL with it. It asked me to update and told me it would reboot. I did the update and the box rebooted. I logged back into XBL from the MS Dash and looked at my friendslist. They were all there and everything was working fine.

I then launched Ghost Recon: Island Thunder to test XBL with it. It connected just fine without anymore updates and everything went well.

I then loaded up Halo 2 from the retail disc with the mod chip off and logged into XBL. It asked me to update and I did. I am able to connect to XBL now and play Halo 2 with no problem. I have rebooted the box 3 different times and connected with no problems.

I will post back with updates if I get banned, but for now it looks good. Please let me know if you have any questions and I will be glad to answer them for you.

For now I have three possible explanations for me not being banned.

1. It has been so long since I have played on XBL that I didn't get the XBL update that registers the HDD/MB unique identifiers until tonight. So, when I logged on tonight it registered them and now when it checks they match so it lets me play.

2. Clearing those files from the hard drive and recovering my account somehow solved the HDD/MB issue.

3. Our theory about having to connect to XBL the first time with the box modded and the larger drive installed is wrong.

Anyway, sorry for the HUGE post. I hope this information helps.

I signed on again this morning and played Halo 2 on XBL with no problems.

my 2 cents

The thing is, when I got banned, It didnt try to connect. It wouldnt even go.  It was like it already knew I was banned. So there is a chance your already banned, and they are just waiting for you to sign in... just a thought

I wasn't instantly banned. I hadn't been on live for about 2 weeks and then connected with halo 2 and had to download an "update" which took about a second. I'm wondering if that has anything to do with it. I was able to sign back onto live afterward, but not the next day.

I am in the "modded after Live" boat as well.

Got Xbox 1.0 in 2002

Got Live October 2003 ... played throught the 2.0 rollout

Got Modded Summer 2004 with xecuter 2.3b and 120gb Locked Seagate

Played Live with modded xbox until about a month ago (When DVD-ROM failed)

Got new DVD today and played a little mechassault live and had a voice chat.

HAVE NOT PLAYED HALO 2 YET AND EVERYTHING SEEMS OKAY.

Thinking about renting halo 2 today and playing, or waiting to see if I get banned tommorrow.   But I really want to play, so I may go do that.

NOTE: Live account is ONLY on my memory card.

I've posted this a couple times before, but I'll do it again if it helps you kids out.
  • Got my Xbox (v1.0) in Dec '02
  • Bought the Live kit at the same time
  • Modded my system in June '04 with the following eqpmt:
    • Xecuter 2.3B Lite
    • 200GB Western Digital HD
    • Did all my formatting, setup, drive locking, etc with Slayer's disk (did it on OEM HD, then FTP'd it's contents to my PC, then FTP'd all of that back to the new HD)
    • Running EvoX 4977
  • Auto login has been disabled since I did my mods
  • Always leave the network cable plugged in, even when chip is on, just have enough sense to not go online while it's on
  • Got Halo 2 at ~7:00PM ET on 11/9, been playing the crap out of it online since then; probably on and offline over a dozen times since Tuesday, and as of 11:00PM ET last night, still not banned

gmrc, the banning is not limited to Halo 2.  Any live game is affected.

Wait my susbscription ends in january, if I mod my harddrive after it expires and register a new subscription and gamer tag It should work fine unless I change my harddrive again?

I think 1)

One of the dates we're working with is when the Live 2.0 update came out (the one you downloaded when you recovered your tag. Which was circa March 9th (8 months before halo2 came out wink.gif)

If you last used XBL before that date, then you're in the clear smile.gif, according to the latest incarnation of Marriage Theory at least wink.gif

Now, the problem is, what happens if you swap HDs after that date... can you do anything? if you swap back to your original HD will you be fine? or are you screwed either way? What if you just swap to a new EEPROM instead?

No, the problem is when you connect to live, no matter what gamertag you use.

There is another problem with your gamertag getting flagged, and that can be easily fixed by just getting another gamertag
