Account Recovery To Block Being Banned?

Has anyone tried doing a Live account recovery on a modded box with an upgraded HD that only has stock MS stuff?

The reason I ask, is that if the EEPROM and HD Serial are joined at the heel, this could cause problems for MS repair centers.  If a user has a stock Xbox with a HD that goes bad they would send it in to MS for repair.  Now, if the user has Live and the marriage idea is true, then MS would need to replace the HD and EEPROM in the system when only one of them is bad.

Now if the HD was the only thing replaced by MS at the service center.  And the system is sent back to the customer, the box would be pretty stock at this point (just like buying a new system).  One of the first things the user is likely to do is an account recovery, get on Live and hopefully not be banned...

Just curious if anyone has any insight.
