You should be fine. Remember your original gamertag will have been flagged though, and you will need a new one if you haven't got one already (since your original banning).

My Xbox with a 60gb HD is banned too, Can I go back to xblive when I have a new EEPROM with the same HD with games and stuff on it, with the same Gamerstag??

Or do I allso need to buy my selve a new HD?

You won't be able to use that 60GB HD on live again. If you put your old stock HD back in with a new EEPROM you should be fine. If your old HD was on live before you upgraded your HD, according to marriage theory the old stock HD will get you banned. However, I did this and I'm not banned after 6 weeks, and with a flagged GT.

I think I can explain this by proposing a new theory:

When connecting to live, checks are made for banned Xbox SN, HD SN.

When your Xbox connects to live it does an MD5 hash of  Xbox SN, HD SN etc. This is stored locally. Each time you connect to live the Xbox recalculates this and compares to the stored copy. If unchanged, no data is sent to live.

If different, the Xbox sends all the current data directly to XBL. This bans the Xbox SN (or rather the HD Key - not the HD SN - but effectively they are the same) and the HD SN. This explains why an upgraded HD present at the time of banning will ban new EEPROMs. As the old stock HD SN was only recorded as part of an MD5 hash, it does not get banned and therefore can be safely re-used.

What happens if you move your live account from one stock XBOX (where u signed up) to another stock XBOX????
Do u get banned because both EEPROM and HDD changed???

No.  Moving a live account from one stock Xbox to another stock Xbox will most certainly not pose any problem whatsoever.  Think about it, man.

The "marriage theory" merely links EEPROM to HD.  The associated gamer tag has nothing to do with it.

I haven't read this entire thread, but i thought my information might help.

My friend was banned a month ago because his chip was on. Two days ago he came over, and using a memory card we put his live account on to my xbox so we could play together. I played all day yesterday on my account after he left. Today after school when i got home i was banned. Chip was never turned on.

Is it possible to get banned without actually having an Xbox Live Account?
In my case, I have a modded xbox with a bigger HDD. I have it networked with an internet connection, I always use it with the modchip on, used the MS Dashboard many times and played games that you say try to connect without asking me (SW Battlefront for example)
Can they have my EEPROM and HDD S/N already or they just register them when I get an account?

Okay all... I read through the first post, but am still a little hazy on my answer to my question.

Here's my situation...:

I have a stock hdd with Evox on it.  I acidentally had the chip on, and it went to the XBL dash, and BAM, i'm banned about 2 days later.

I bought a new eeprom, did not know about the hdd can be banned too, so now that eeprom is banned as well...

here is my Question:

If I install a NEW upgraded HDD, use a 2 month card to make a new account, and install a unbanned eeprom to the upgraded hdd, would I still get banned?

ALSO!!!  Major concern about this one... Banned accounts don't get charged again do they?  My 2 month was gonna expire in like 10 days, and I was set for the yearly payment option.  Will I get charged $49.95 on my banned account???

Thank for any info!!!

They have only banned your XBOX, not your account or gametag, so you will be charged.  Call up and cancel.

I'm unclear to what my options are.  Bear with me, I'm new to the mod scene.  I've been playing on Live since beta and my chip will be arriving shortly.  Are there steps I can take to get an upgraded drive online?  I've read the tutorial on how to do it with an evox CD, is it possible to have evox on the HD?
