Sorry if this is a dumb question, but all this talk of new banning methods got me thinking.  Isn't it possible for them to ban your xbox live account even if you don't log onto Xbox Live?

Example:
You leave your ethernet cable plugged into your xbox for easy ftping to your box.  Since your xbox is plugged in, it has internet access.  Then say a game is programmed to check if you are running a non-MS bios, different hard drive, different files on c:\, etc.  Since you aren't going on Live, you turn on your system with the modchip on and play this backed up game as single player, but the game sends this collected info  (along with your eeprom) to a MS server via the internet (since you are plugged in).  You would then be banned from Live without you even logging onto Live.

Just a thought.
