This is all bs, MS can't do jack to us..They are just trying to scare you, It's obvious that MSs knows if it bans everybody with modded xbox on xbl, it will be a loss for them.....THink about it, how hard would it have been for them to make a program that checks for evoxdash.xbe, avalaunch.xbe or unleashx.xbe in your hard drive ?   That would be the easiet way to ban people , because without a dashboard, your modded xbox is useless, so everybody has it ? Instead, as long as you go on live with a retail game, then it's good for them . Face it, ms says this stuff to scare you and send a message for those who wanna mod there boxes..But deep down, they need us, and they know it.
