I Need Help!will I Get Banned

I have a modchip installed and its called ALX2+R3 and to load the original bios all I have to do is press the Eject button to turn the xbox on and the chip will not be loaded. I have upgraded hd to 80 gig and have put files on C: and E:.Will I be able to use xbox live with my mod chip off because im goin to order halo2 and xbox live.
