I think ILLusions0fGrander have the answer in his Sig! I don´t belive in the HDD serial theory. I think they check for known game hacks (or modified savefiles that the cheater likes to call it).  We know for SURE that the one in the Sig and four more forum members have been banned for PGR2 hacks.

I belive in this senario.
X playing fine with modchip off for years but have a game hack on the HDD. X might not even remember it´s there and maybe never play that game nowdays.

MS found out that ppl cheat on live. They will not ban all mod users but stop cheaters. So they found a way to check for known hacks.

X logs on to live with modchip off and get banned. He can´t understand how he got banned but go for a new eeprom. He might suspect that the ban can have something to do with evox on C or other files and therfor clean the HDD before going on live again. However he don´t wanna lose all saved game so he take a backup of E. Then transfering back the gamesave to the newly formatted HDD and goes on live.

X gets Banned again!

OK then maybe some one can put it to a test. It would, however, require the sacrafice of a new box.  Take a new box, copy a couple of the know hacked saves to a mem card and dump them to the new box and then connect to LIVE with a game other than the ones the saves were for and see if that box gets banned.  Don't use it for anything else.
IF it suddenly gets banned then we'll know for sure that it is scanning for the known hacked saves.

I'd do it but I don't have an extra box. I've just got the one.

Miggidy,

I don't know about your hypathetical.  But what I was meaning was if some guy gets banned with a eeprom that he bought from somewhere on the net,  and that seller he got it from is a jerk looking to increase his profits, what is to stop him from selling that eeprom again? 6 months down the line when the next guy buys it he logs on to live and plays for 1 day than is banned.

I think the issue that you raised Miggidy would not result in ban until you both logged on to live at the same time.

I'm pretty sure that MS was checking HDD serials sine before then.  I have a vague memory of when SmartXX made that announcement.  Several people in the scene pointed out that HDD serial checking has been part of Live for quite a while (maybe even from the begininning).

I dont believe in the save game/save game hacks theory. Reason why: it is ilegal to scan the hd for files.

well in my country it is.

I'm Skeptical about the saved games theory aswell, only becuase of the existance of "Action Replay" and its high popularity.  Case in point would be if a 8 year old gamer was having a hard time getting past some chapter in a given game that holds "Power Ups" "Weapons" or whatever may be of particular use on live.  He/She may turn to action replay to retrieve a save to obtain this level.  If he/she is unaware that a particular game save has been hacked he/she may be banned from x-live without notice.  I think that such would be unreasonable by MS, and would also place them in a position where they are unfairly enriching themselves as MS offers no refund for partially used subscriptions.  Also if you are a month to month live subscriber and you are banned, does MS continue to debit your credit card until you cancel?  I mean what about the kid that dosent realize he has to tell his parents to cancel, maybe because he is afraid he will get in trouble for getting banned?

But again MS may just take that chance and say "we'll deal with the innocent victims latter".

I think you should have read the Terms of use that you did accept when you signed up for your Live account.

" {b} retrieve information from the Xbox used to log onto the Service as necessary to operate and protect the security of the Service, and to enforce this Agreement"

funny thing this english language!!

"...retrieve information from the Xbox used to log onto the Service..."

thats somewhat vague aint it?
