Crapola!
Some games DO attempt to connect to the live servers unbeknown to the user, usually at startup.
These can get you banned if you are not using one of the newer bioses that prevent connection attempts when they are on. (Wow are these wonderful!).
However they DO NOT "pre-mark" the Xbox to be subsequently banned later.
Bottom line to be safe:
- Use a newer XBLIVE disabled BIOS.
- Leave the hard drive locked or lock your updated drive.
- Leave the original MS (or updated) dashboard on C:\ called XBOXDASH.XBE, and don't screw around with it. Preferably use the latest one if you want progressive scan.
- DO NOT disable the XBLIVE Disabled feature on the hacked bios.
- Install a switch if needed to flip between the two operating modes. With an older TSOP this is pretty simple, if you follow the tutorials to split the TSOP into to 512k banks.... one bank for Live, the other for the hacked BIOS.
This is pretty safe and idiot proof if done properly. A friend, sibling, significant other, is unable to accidentally get you banned as well.
