Live Aware Games? Banning?

Hey, if you have live dash 2.0 installed. But when your modchip is on and you boot your console to Evox and play a game e.g. SPLINTERCELL that is supposedly Live aware, does it connect to xbox live and you are banned now?

I just loaded up COnflict Desert Storm, it had the content download option, I was like FUCK...So am I screwed now? Ofcourse I didnt' clik the content download button, but was wondering if this is a so called live aware game...
