Yes, to get your Xbox unbanned from Live, you need an unbanned EEPROM.

Then you did something wrong or your friends eeprom has already been harvested (Very unlikely if he bought it legit and you reflashed his tsop.)
I've given away a few eeproms and no one has had anyprobs.
Make sure you use config magic to reprogram your eeprom and make sure your backup is valid.
