Thats what i thought but i have since been told that the MS Dashboard detects the mod (after the dash update) and "flags" the eeprom ready for banning once you DO connect.

is it a good idea to back up my eeprom now.  so i will have it later on if i get banned so then i can delect the banned one and replace it with the unbanned one?

You never downloaded any content! And no, they can't bann you unless you connect, stop being paranoid.

Well, i am about to get Live so hopefully can someone who has more knowledge than me on live, such as shanafan confirm that my eeprom has not been flagged, or that i am or am not banned from future use, and if so a way to fix it?

you said your xbox wasnt even connected to the internet, THERE IS NO WAY THEY CAN BAN YOU WITHOUT CONNECTING TO THE INTERNET WITH YOUR MOD ON!.

Exactly, BUT apparently the updated dashboard detects the mod chip when turned out, and flags the eeprom so that when I eventually do connect to the internet i will become properly banned.

I'm confused.....you said the network cable wasn't plugged in, yet you downloaded a dashboard update? How is that possible?

Why doesnt just someone call M$ and ask them? I know I don't want to but tell them I know you ban on mod chips n stuff with it enalbed, and how their system works, try to use a payphone or a cell phone =D if you do call them this would solve all the issues that everyone is asking and which games support the eeprom banning with it being flagged. plz do not flame me, just a suggestion thx.

By choosing a live option inside a live enabled game.  When doing this, regardless of whether you are connected to the internet or not the dashboard updates itself with xbox live.
