I'd really like to see something like this as well.  There's got to be some way to do it.  I thought about electronic methods based on whether the ethernet cable is connected, but then you wouldn't be able to FTP and such.  Anyone else have any ideas?  Partly I don't trust myself, but I'm also slightly paranoid that certain games might go out and look for Live without asking.

If you are worried about getting banned when using your modchip you can either set an ip filter on ur router or just unplug the actual cat5 cable

Uh, no.  You don't understand.  I want to protect against me forgetting that my modchip is on and connecting to XBL.  'Unplugging the Cat-5 cable' is just another thing to forget.
