Banned Without Installing Xbox Live Kit?

It modifys xboxdash.xbe because it adds a Xbox Live link to it. Like were it says...... and stuff it adds a Xbox Live section onto the main dashboard.

Xbox Live install installs Xbox Live. lol

And im not sure about that last question.
