You need to have the chip turned off before you turn on your xbox.

If you would like to play your backed up games online, use either www.xbconnect.com software or gamespy's tunnel program.

what IF the EvoX team could try to fool XBox Live into thinking that the EvoX bios is infact the XBox bios? Then surely this would be possible?
