Not quite!

Several games are known to check the dashboard status upon game start not when going into the Live configuration.

The Xbox Live Beta disk also does this, it updates the dash upon boot without user intervention or action.

You said it -AFTER THE LATEST UPDATE-.

Had you not already had the update installed, it would have been automatically attempted.

I don't know about the other live enabled games. But when you put the final live beta disk in (with whacked and motogp on it) it will update the dash on boot. I figured as much would happen. So since I didn't use the evolution dashboard anyway, I replaced it with the original files and removed all the extra stuff from my drive.
But I did see that someone posted on another site how to launch evolution from the xbox live entry in the original dash. But there are a ton of how-to's on getting the dash to work after the live update so no need to go into it here also.
