Umm linux is the software that you are trying to use, the mod chip is where the reverse engineering comes into play.  The linux kernel was built from scratch and that is perfectly legal.  They used reverse engineering to find out how to circumvent the protection on the xbox, and they made mod chips, then under this law they have the right to provide this means (the mod chip) to anyone for interoperability with legal programs either built by yourself or some one else legally.  Linux was built from scratch legally, they did not reverse engineer any copy protected code to make the linux kernel for xbox.  (inside the xbox contains the code that you LAWFULLY aquired) About the suing, no one can say for sure how a judge would rule and MS hasn't refused any refunds that I know of so it's a moot point anyway.

Wait am I missing something here. The Linux code is software (O.S.). It requires a hacked BIOS to run it on. All hacked Bioses come from the original MS code. Any BIOS created to date is ILLEGAL. Ok, I agree that the Linux code may (MAY) be legal but the BIOS you are installing to run the Linux code is illegal. Correct me if I am wrong!!!

What it comes down to is this, if you don't like XBL then find something else. What are the other options? It has been proven many times over in the PC gaming industry that the pay services are never as successful as the free services. PC Quake is the perfect example.

Let's not waste time discussing how we are going to get MS. The best solution is to use something else besides XBL. This solution will cost them much more in the long run!

                                    No flame intended. The BIOS is the sticky part here. I am not sur ehow long it will be until a 'from scratch' bios is written, maybe never!

RichH is right,
The bios is illegal along with the linux code because it was modded using the illegal ms sdk software so that is would run on the xbox
