I also think it's hard on people who had somewhat a "legal" use (c'mon, MS is not releasing Bistro Cupid on US, so they're not loosing market if I import it). I know that the modchip is ilegal as it does include MS code on it, but it's also MS code you paid them to use anyway. This could go on forever as we can talk about end user rights, but that's not the point, as by the other side MS would have the rights to protect themselves.

Let's wait to see what they'll do next week and how they'll deal this issue. AS for me, I'm just waiting, I don't have the Live kit and the games I WANT to play won't be out until March/April next year, so I'm not on a hurry, but people who paid for the kit will complain, and it'll be interesting about how MS will start a flame war with people pissed by being not able to use what they paid for.
