A bit paranoid?

The question is not if they could, it's why would they ever want to?

They are already getting lamblasted about the anti-mod policy right and left in the media.

They get blasted about any attempts to peek into users machines (as they should!).

One story in the paper would set off a firestorm.

No don't worry so much. All they MIGHT do is force you to have an original in the tray, and even that is pretty doubtful now.

Yeah and Uncle Billy would be missing revenues as a result...

We -KNOW- MS's priority... MONEY. Excluding the modded boxes would be a bad move financially and politically.

Even CNN already blasted MS about their Anti-Modder stance.

However, MS and third-party game operators reserve the right at all times and without notice to delete any content and to monitor, review, retain and/or disclose any content or other information in MS's possession, however obtained, about or related to you, your use of Xbox Live or otherwise as MS deems necessary or useful to satisfy any applicable law, regulation, legal process or governmental request.

If i'm not mistaken that section does NOT give them the right to do anything to OUR x-boxes.  Somewhere else in the EULA might say something, but the above section specifically says:

"However, MS and third-party game operators reserve the right at all times and without notice to delete any content...in MS's possession"

This part of the EULA seems more towards them saying: "We can log you on our xbox servers and we can delete anything we want on our servers and we can disclose our logs to anyone to satisfy a law"

I'm not saying MS hasn't had us sign our lifes away somewhere else, but this surely doesn't seem to be that bad.
