To play a backup game you need your mod enabled yes?

If you sign onto live with your mod enabled you will get banned no?

For the most part yes, but that should be changing soon. Very recently, the samsung drive was hacked, allowing for the xbox to play modified firmware. It will just be a matter of time for the word to spread, and for average hackers to begin to do it.
