A program should be developed where it restricts access to the xbl servers while you mod chip is on. it would do something like monitor the incoming and outgoing connections of the xbox.

sounds good....
just think of it like a firewall program...
it cut's xbl network port when using non-original bios...

So you'd want it to block Live packets but allow transmission of FTP packets and System Link packets?  This would require that it identify the content of the packets, which I understand to be very well encrypted.  Perhaps there would be a way of identifying the packets as Live packets without decrypting them.  I'm sure there is an easier solution that could run internally to the Xbox, however.
